Terms of Use
Version 2026-10-16 · Last updated October 16, 2026
These terms are an agreement between you and [legal name of the company] ("Elephant Diary", "we", "us"). They cover the Elephant Diary app and website (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. What Elephant Diary is, and what it isn't
Elephant Diary helps a parent keep a private, organized record of parenting time, events, expenses and related documents. Each entry is sealed with a fingerprint and the time it was received, so later changes can be detected.
- Elephant Diary is not a law firm and doesn't give legal advice. Nothing in the Service, including the lawyer package, time-share figures or suggestions, is legal advice. Talk to a lawyer about your situation.
- No promise about court. Whether a court accepts or relies on any record is up to the court. We don't promise that your record will be admitted as evidence, or any outcome.
- Tamper-evident, not tamper-proof. The Service is designed to show when sealed entries have been changed. It can't stop anyone from writing something untrue in the first place.
- Not for emergencies. If anyone is in danger, call your local emergency number (911 in Canada and the US, 999 in the UK).
- Figures are estimates. Time-share and expense figures are calculated from what you enter and the schedule you set up. Check them before relying on them.
2. Who can use Elephant Diary
You must be at least the age of majority where you live, and be using the Service for your own family. One person per account; please don't share your account.
3. Your account and keeping it safe
- Your password unlocks your record. Your record is encrypted on your device with a key protected by your password. We never receive your password and can't read your record.
- Keep your recovery code safe. If you forget your password, you can reset it with your recovery code and access to your email. If you lose both your password and your recovery code, we can't recover your record, unless you turned on assisted recovery.
- Assisted recovery is optional. If you turn it on, we keep a copy of your key so that an emailed code alone can reset your password. This also means we could open your record. See the Privacy Policy.
- You're responsible for activity in your account. Use a strong password, consider turning on two-step verification, and tell us right away if you think someone else has accessed your account.
4. Your content
Everything you enter or upload (entries, photos, documents, notes and settings) is your content. You own it. You give us permission to store, copy and transmit your content, in encrypted form, only as needed to provide the Service to you.
Because your content is encrypted before it reaches us, we don't review it. You're responsible for it. In particular:
- Record things honestly and accurately. Elephant Diary marks entries written well after the event as "written later".
- Only upload material you have the right to keep and share, and respect other people's privacy.
- Follow any court order or agreement that applies to you, including any limits on recording, sharing or contacting someone.
5. Acceptable use
Don't use the Service to break the law, to harass, stalk, threaten or intimidate anyone, or to store material that is illegal. Don't try to get around the Service's security, access other people's accounts, interfere with the Service, or copy, resell or reverse-engineer it. We may suspend or close an account that breaks these rules.
6. Free trial, subscription and payment
- Free trial. New accounts get a free trial (currently 14 days). You add a card to start it. Your first payment is taken when the trial ends, unless you cancel before then; cancel during the trial and you're never charged.
- Plans. Elephant Diary is a subscription, billed monthly or yearly. The price, currency and billing period are shown before you pay. Taxes are added where they apply.
- Automatic renewal. Your subscription renews automatically at the end of each billing period, and you're charged the then-current price, until you cancel.
- Cancelling. You can cancel at any time in the app (Settings, then Account, security and subscription). Your access continues until the end of the period you've paid for, and you won't be charged again.
- Refunds. If you're not happy with your first payment, ask us for a full refund within 14 days of it. Otherwise payments are non-refundable, except where the law says they must be refunded.
- Price changes. We'll email you at least 30 days before a price change takes effect. It applies from your next renewal, and you can cancel before then.
- Payments are processed by Stripe. We never see or store your full card number.
- Failed payments. If a payment fails, your record is locked until the payment goes through. We try your card again over the following days; if it still can't be charged, your subscription is cancelled. A locked record isn't deleted straight away: see section 7.
If you live in the UK, you have a legal right to cancel within 14 days of buying. When you start a paid subscription, you ask us to begin providing the Service right away; you may then receive less than a full refund if you cancel within those 14 days. Our 14-day refund on your first payment covers this in full.
7. When your trial or subscription ends
If your trial ends without a plan, or your subscription ends or is unpaid, your record is locked: it can't be opened or downloaded until you choose a plan again. Nothing is deleted straight away. We keep a locked record for 12 months from the day it locks; choose a plan within that time and it opens as it was. We'll email you when it locks, and again 30 days and 7 days before the 12 months are up. After 12 months locked, we delete your account and your record, and it can't be recovered. Download a copy before your subscription ends if you'll want one. You can ask us to delete your account sooner at any time.
8. Requests from courts and authorities
We may receive subpoenas, court orders or other legal requests for information about an account. We'll only respond when we're legally required to, and where the law allows we'll tell you first. Because your record is encrypted on your device, we can usually only provide encrypted data and the account information described in the Privacy Policy. If you turned on assisted recovery, we could be required to decrypt your record.
9. Changes to the Service and these terms
We improve the Service over time and may change or stop features. If we make an important change to these terms, we'll tell you in the app or by email, and you'll need to accept the new terms to keep using the Service. If you don't accept, you can cancel your subscription and ask us to delete your account.
10. Ending your account
You can stop using Elephant Diary at any time, and ask us to delete your account by writing to support@elephantdiary.com. We may suspend or close your account if you seriously break these terms, or if we have to by law; where we can, we'll tell you first and give you a chance to download your record.
11. Disclaimers
We work hard to keep Elephant Diary available, accurate and secure, but the Service is provided "as is" and "as available". To the extent the law allows, we don't promise that it will always be available or free of errors. Keep your own copies of anything important, such as the lawyer package or CSV download.
12. Limitation of liability
To the extent the law allows, we aren't liable for indirect or consequential losses, such as the outcome of a legal proceeding, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits rights you have as a consumer that can't be limited by contract, or our liability for our own fraud, gross negligence, or death or personal injury we cause.
13. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. If you live elsewhere, you keep the protection of the consumer laws where you live, and you can bring a claim in your local courts.
